Dealer won't give me my truck

First off, thank you all for your advise. The advise from klenger about contacting the dealership owner was very valuable. And swexlin's advise to contact the BBB may prove to be very useful.



At this point I have contacted the owner. He has put our truck in their back lot so that it won't be sold while we try to resolve the situation. The owner also said that the general manager is "vehement about not selling the truck" to me. The owner is still talking to all the dealership employees involved to find out more about the situation.



I've talked to a lawyer and he says that I have a slam dunk case. However, I'm not sure I want to go that route. I'd rather exhaust all other options before taking the dealership to court.



I called DC and they said that there are franchise laws that prevent them from forcing the dealership to comply. However DC does control the five-star program and said they would note the problem for the dealer. DC also said that legally, I had a good case.



Since I still want to resolve this problem amicably, I have sent an apologetic letter to the general manager. In the letter I apologize to him and the other dealership employees I dealt with. I ask if there is any way that the truck deal can still be salvaged. Hopefully this letter will help get the situation resolved without getting the BBB, local news, or lawyers involved.

The dealer should be apologizing and you should have been driving your new truck days ago!:confused:
 
RankRam, the owner said that the general manager and some dealership employees felt offended by how I treated them. How I perceived the situation does not diminish the perception of these people or how they feel. I can either dig my heels in and get mean, getting a truck several weeks or months down the road, or I can be apologetic and get my truck now. I'd prefer the second approach.
 
I agree about keeping it civil, but I don't agree about an apology being offered. Then again I was not there so I don't know how you handled the situation. I know I would have been mad as hell. I may have had to apologize to the entire dealership and their family's as well.

Don't walk away from that dealer - RUN! You don't want to do business with someone like that. Do you think you'd ever feel comfortable leaving your truck there for service of any kind? Why would you want to give them your business? It does sound like the owner might be a decent person, but the damage is done. And if he doesn't have the stones to override his GM, then he's no help to you anyway. In fact, if he had any kind of sense, he'd know this GM is damaging his business and get rid of him.



As some have said - yes - it's only $100. But it most definitely is the principle of it. It's about integrity, and this general manager obviously doesn't have that quality. There's no way I'd drop a dime in that place. It would be worth $1000. more to me to deal with a place that treated me well. When I ordered my truck, I shopped around for prices. My local guy who's 10 miles from me gave me the best price with the comment "and no surprises". When I took delivery 2 months later, that's exactly what I got - no surprises. When I go there for anything I'm treated well, and I bought another car there last fall. THAT'S what customer service is all about. If I were you, I wouldn't want to deal with this place even if they dropped the price another couple of hundred. This is a giant red flag about this place.



I'd cut my losses at this point and call Tomeygun in St. Louis. I don't know Tomey, but everything I read here says he's a straight up guy. Good luck with whatever you do.
 
It is nice that you are apologizing and trying to be nice and all , but I would rather have the satisfaction of raising some major hell... ... ... Then when you apologize later you can feel more sincere. :D

I've known dealer owners who for one my not tell you how OFFENDED and vehement the sales manger or employees were. HE would just tel them to honor the deal and make it happen.

Thank you. Hit them HARD. This dealer is like a spoiled child. Don't give in. Only because you stood up they might treat you with the proper respect. There employees felt offended? I guess I have heard it all. They are playing on your sense of fairness.



Its too bad that we have to make a fuss to get these guys to keep there word.



My truck is on order in the CA bay area. I think I made it very clear that if their was any horse s%#t when I picked up my truck they would have a problem.



I know they took me at my word.

I got to thinking about this today. You need to find a friendly dealer to "locate" a certain equiped truck and then have them transfer that truck to them. It would just happen to be the same truck they won't sell you now. Then pay for it and pick it up from the a hole that is screwing you around. :D That would be a lot of satisfaction to drive it off the lot. :D
 
If Barber Brothers Motor Company at 1341 N. Main Street, in Spanish Fork, Utah , 1-801-798-7431 was smart they would either honor their original agreement or allow another dealer to take the vehicle and make the same deal and get this all behind them. It would be a simple way to make it all go away. This is pathetic. Everyone makes a mistake and I gaurantee I've had to eat my share of them. Barber Bros. Can you read this?? 20,000 members are plus the other 50,000 that are guests. Do you understand????.
 
Good news. General manager called me and said I could have the truck. I know some of you thought I should have dug my heels in but the important thing to me was getting the truck. The GM was nice and we had a good conciliatory chat.



Thanks for all your comments. The advise to contact the owner seemed to help the most.
 
Glad you got it resolved. I can't imagine any salesman with that thin of skin..... If my wife had got a hold of them they probably would have dialed 911.

Glad you got your new truck & hopefully any warranty issues will be handled in a professonal manner.

NEVER BEG A MAN TO TAKE YOUR MONEY



There's always another truck right down the road.



I would have walked, if you can't trust a man in the small things you can't trust him in the big ones - do you trust a dealership who would screw you over $100 on the purchase price, to do good and honorable service on warranty work, safety recalls, etc?



Caveat emptor - as true today as ever.
