Second time in 6 months someone ran into my truck #ad
. This one is much worse than the first when I got rear ended in traffic.

I was running some errands yesterday when a car crossed the center line and smashed my truck from just behind the drivers door all the way to the rear bumper, tearing the rear axle out from the under the truck in the process. Both my 4 year old son and myself emerged relatively unscathed (bumps and bruises, he was a little shaken up) and no one was injured in the car that hit me.

The girl that hit me, must of been around 19 or 20, doesn't even have a drivers license. She had taken her sisters car to take an infant for a ride that was fussy and wouldn't take a nap. She thought the car ride would help the baby fall asleep. She also had a 3 to 5 year old boy with her. The police were asking lots of questions as they only found one car seat in her car!

She was driving way to fast on a twisty bumpy road and lost control on a left hand curve at the top of the hill. She started sliding right, got into some gravel/grass and lost it. She over corrected on her final attempt and shot back out on the road about 45 degrees to the center line. I moved onto the narrow right shoulder in an attempt to avoid her but she caught me on the drivers rear quad door.

She must of been going at least 50 mph when she lost control and her car seemed to speed up as the front wheels regained the pavement and shot back out onto the road. She didn't touch the brakes before impact. It scares me to think what the outcome would have been if I hadn't moved to the right as far as possible. If that car had hit me in the front end people in that car would have killed. I don't think my truck would have moved much and the windshield of that car would have gone under my front bumper, thank God that didn't happen.

The force of the collision spun the truck around nearly 180 degrees counter clockwise, sort of pivoted on the front wheels, and pushed the rear end of the truck off the road and into a farm field type fence (barbed wire and welded wire strung on metal posts). The rear bumper took out several posts, one of which wedged between the bumper and the passenger rear quarter.

The rollback operator had a heck of time getting my truck on the back of his truck ( F450 SD with a 460 #ad
). He had to cut the fence appart with bolt cutters to free the truck from the fence. He had to winch the rear axle back under the truck, then work my truck onto the flatbed using the winch and sliding the bed. When he finally got it loaded, the drivers rear wheel had to travel on the tow rig behind his flatbed

The rear axle was torn from under the truck, frame looks moderately twisted. The drivers quad door and cab are damaged and the bed it trashed down the side below the belt line. My ARE cap is also badly thrashed. Lots of other damage on the rear of the truck as well.

I am going to have to fight to get this thing totaled. The car that hit me, 2000 Pontiac Sunbird, is trashed to and including the windshield.

I love this truck but I don't want it back. I don't think it will ever be the same if they try to fix it. If they do try to fix it I am going to pursue a diminished value claim. Anyone have any advice on how to handle the whole accident situation?

I can't tell you how sorry I am to hear that. First and foremost, thank God no one was hurt. I know you loved your truck but hopefully this will turn into something good in the long run (new truck?). I had a similar situation a few years ago when we were hit by someone. The insurance company said our car wasn't totaled but I pushed a little and they totaled it. I think they'll be a little more cooperative since it wasn't your fault. They can basically go after her insurance company for the entire amount. I'm not sure about the insurance laws up there but I hope it works out that she's covered under the car's policy regardless of her license status. Keep us informed and best of luck to you.

It's great no one was hurt from the insurance standpoint also. I've learned the insurance companies are more willing to deal fairly with the vehicle damage aspect when the huge medical expenses aren't involved. With a bent frame the truck will never be right again. Glad no one was hurt badly, sounds like everyone was wearing seat belts.
 
Real bummer man! sorry... I think it all depends on the insurance co. my step niece had a small accident ... a lady driveing a jacked-up PSD pulled out too far in an intersection and didnt see my niece behind her and backed up and creased the hood a bit and the insurance co. totaled it. . so go figure!seems like if the axle is tore out they would total it. dunno... ? keep your fingers crossed.

Dave, Sorry to hear of the mishap!I can feel your pain my friend. Only yours is a bit worse than mine was. Glad you and your son are in good health and no one else was hurt. If the frame is bent like you say it is, I'd take care of business and find another truck IMHO. The girl that hit you sounds like she's in deep doo doo!

Fight for the total, but that doesn't get you everything back. Make a claim against her (or her sister's) insurance liability for a new, undamaged truck. Make sure - absolutely sure - you get a good med eval to make sure there's nothing that will pop up later, too. If there's nothing, the insurance company should be happy to get out of an accident like that for just the cost of a replacement vehicle.

I hate to say this but I doubt they total it. I have seen body shops replace frames like it was nothing on a truck. Its going to be tough but hopefully they will total it. The newer the truck the less likely they are to total it... . and they don't get much newer than yours. But its good nobody was hurt!

Dave, like everyone else, I'm glad no one was hurt. Keep your 4 year old in the rear seat when possible, and when he has to be in front, move the seat all the way back and disable the air bag. I do disagree with the above quote. A good body shop can make your truck so that it looks, acts, and basically is the same as never been wrecked. The key is finding a good body shop, there are way too may bad body shops out there. Totaling the vehicle will simply be a matter of economics, will it cost more to fix your truck than it's worth? Hard to say from here, but if they don't total it, you still have some options. Ask the insurance company to put you in touch with a buyer. You can take the insurance check, and sell the truck as is. And with the high salvage value on trucks (especially Dodge/Cummins), you might make more money this way. Just make sure the insurance company allows for all damages, as well as potential hidden damages. Good luck to you.

Glad y'all wern't hurt.

See an attorney as the other insurance will not pay if the driver was not owner and was unlicesned. In which case it will be your ins that will pay. You might end up sueing the owner if they gave permission for unlicensed to operate, and possibly their home owners liability ins and getting a judgement against the driver even though you will never collect the judgment. The ins co. ( either one ) will depreciate the truck, that is why you need to collect the deficite from thoes who were mentally culpabe for their actions

just an FYI. . one year ago I paid $5600 for the salvage value of my 98. 5 3500 4x4 5sp with 80K miles . . fully loaded rig . . don't know if your looking to part it out yourself if they total it. . running gear alone worth more than the salvage value
 
Do yourself a favor and stay up on the laws in your state regarding her lack of a drivers license. You need to protect yourself here (BIGTIME).

Bummer about your truck, it looked like a keeper at the Big Rig races. Keep us posted hope you get a new truck.

Maybe you should get an attorney to look out for your interests.

Dave, Sorry about your truck and glad to here everyone is OK. Just be thankful that you chose to haul your loved ones around in the RAM. I drive a tow truck for a living and see some terrible accidents. That was the main reason I chose to put my wife and 2 boys in a Dodge Ram. The Cummins definitly impressed me, but the size of the truck is what sold me.
Make sure to contact your insurance company and let them know what's happening. Sometimes they will get the ball rolling a little quicker. Insist on a Rental car, they hate to pay for that and sometimes that makes a differance. Like others have said, it will be tough to total a truck as valuable as yours.
I love my truck too, but it is just a material possesion. Go hug that 4 year old and don't loose any sleep about the rest. It will work out. Good luck. Jay
 
As with all, glad everyone was uninjured.

First and formost: DO NOT SIGH ANY TYPE OF INJURY WAIVER with either insurance company. That is usually the first thing they ask for. You may actually have an injury that won't surface for several days. (My mom recieved a disabling injury from a car accident, took 3 days to show up. )

If they are real slimey, they may try the "If you sign off on injury, we'll total your truck" scam. That's when you absent mindly start rubbing your neck and say "Buy me a new truck and the soft tissue injury might disappear". (Fight slime with slime? #ad
)

Realisticly, you need a new frame (they usually get pretty buggered up when you use a 2000 Sunbird to removal the axle), axle (housing or assembly), box, rear bumper, driveshaft, cab (if the door frame is distorted far enough) and rear door. Sounds like a total to me.

Good luck and fight for it if you have to.

Glad nobody was hurt, as many have said of all things on the road I do feel safe in my truck with it's weight and actually pretty safe ratings. As Willy'slover said I helped him part out his totaled truck and there are a lot of things (especially since a rear end type collison) that you can make some money on if you are able to buy back the totaled truck. There is a perfectly good 24v Cummins sitting under a untouched hood... Hope they total it for you I agree even if they make it look like new, you will know different.
