If their offer was MSRP, the issue wasn't the survey, it was $$$$$. Walk away from any dealer who would pull that crap on you. That's bait and switch with a big hook!!! Personally, I'd call the zone office and complain.

I agree, sounds like bait & switch to me too!!!

If you had an agreement in writing & you tried to keep your part of the agreement... . (momentarily stalling on a surprise price increase wouldn't seem just cause to cancel the whole deal!)

Seems like you might possibly have some legal recourse, but as I have absolutely no legal expertise, you'll have to ask someone who does!

Like others have said, call a zone rep or higher first & see what they have to say about it... then maybe ask around to see if you can find someone with some legal expertise!!!

Meanwhile, do you really want to do business with this dealer????

Good Luck, DanDee

One, either you guys aren't reading what the man said ( That he DID offer to pay the $100) or you guys are the reason corporate America is the way it is today.

Give up and go home? Pay what they want your still getting a good deal? Don't fight for your contract? The guy had a CONTRACT you guys need to grow some bones and stick up for what is right instead of weakening the consumer. 10 years ago any company would have bent over back wards to please the customer, now "McDonalds" will ARGUE on the phone with over anything, it's pathetic and alot of fault of the spineless consumer over the years. :-{}

Disclaimer: The views represented are mine and mine alone, it was not the intension of the author to forcibly make other member's grow a spine. 2 Dodge regional manager's were injured during the writing of this reply (that's the way it has to be). No OTHER animals were injured.

Well, looking at it one way, if he had just been able to pay the extra $100... . he still would have gotten it for $650 under invoice, which is a still a pretty good deal in my book!

(However it really seems like maybe the dealer was looking for a way out!)

If he had a binding legal contract, then your right! However all contracts I see when I'm signing papers at a dealership... . ONLY protect the dealer!

So unless he had an attorney draw up a contract & had the dealer sign his contract prior to the order... (which probably should be standard ops, considering we are dropping $40k+ on these things!) I'm going to guess that the dealer knows exactly what he can get away with!:(

PKitchen... . here is a link thats good reading:

Applies to all Chrysler products, but has some helpful hints if you take the time to read thru it!:)

I picked mine up last Saturday and the increase was $86. The dealer was very apologetic about it and showed me the paperwork. They had been treating me really well and presented to me that way I paid it no problem. However if they were jerks about it who knows...

This dealer is very lucky that they are not dealing with me. I would be standing in front of the dealership with a sign warning customers Saturdays and Sundays till the begged me to take the truck at an even bigger discount. Yes my time might be wasted, but I believe in standing up for myself and not letting this kind of thing happen.

The $100 wouldn't have killed the deal, but when they refused to sell me the truck everyone in that dealership would know I was there. I have a very short fuse if I believe I am being lied to or manipulated.

Find out who OWNS this dealership and contract them directly. Address them with E-mail and cc Dodge customer service.

Hope things work out for you.

Sounds to me like you're lucky you found out about how this dealer operates without it costing you much money. Get your emotions out of it, it's just a dam truck. Go get one somewhere else.

Cheers,

Steve J.

Forget about taking your case to a lawyer. Your damages are the difference between what you would have paid for the truck the dealer now won't sell you, and what you will have to pay to buy the IDENTICAL truck from someone else, plus interest at about 5 or 6 %, IF you have to pay more. In all likelihood, the difference will be less than $3,000. In most states now cases under $5,000 go to Small Claims Court, where the parties involved are not allowed to have lawyers represent them in court. The dealer can't have a lawyer either, but the dealer will send their employee who has A LOT of experience in small claims court, and who appears there on all the cases in which the dealer is sued for less than $5,000.

some of you guys dont seem to get it. they do it to one person and get away with it thinking they can do it to the next person, and so on ect..... ive never been to court never sewed anyone just not that kind of person but stuff like this you have to take it all the way, some of you guys say shut up and buy it-your still getting a good deal- that is not the point. Jake

I ordered 1-30-04. When truck finally arrived 9 weeks later, price had increased by $200. All I had to do for those 9 weeks was to look at the numbers and read up on the new truck - so I knew the numbers very well. I told the dealer that I placed an order based on the old price. It clearly says on the order detail sheet that the price is not guaranteed. They filed with DC for price protection on the order, and so I did not have to pay the $200. My salesman was excellent to work with and though I have not received a survey yet, he will get high marks. Got the 600 for the price of a 555.

Did not drive the truck today, and I am actually looking forward to going to work tomorrow (stress on GOING :D :D :D ).

tomorrow's a new day. Call Dodge immediately so they can start working on their end, if they want to. Explain the circumstances and they may go to bat for you with the dealership. This was a custom order for you, during the 0% + $2000. 00. It's worth asking, they may be able to help you out someway, somehow, maybe somewhere else.

Good luck, let us know. I was going to go through them, but I'm going with Tomeygun.

Well I HAVE. Twice over 25 years. WON both times. Collected on one the other filed belly up two days later and stiffed me and HIS attorney. The other I collected. Only took a few hours of time to make happen. It is sometimes the ONLY way to prove a point. IF the law would allow a good hickory across the nose that sales man/dealer would think twice about it next time. Just plain being a buttwad. :-{}

Small Claims Courts don't all have the same rules - In some States Attorneys are allowed! This is from Utah:

Can I Bring An Attorney?

No. You do not need to retain a lawyer to sue in Small Claims Court. In fact, in most instances, attorneys are discouraged from attending.

You can bet your boots that the Dealership won't have Joe Blow the Sales Manager there - it'll be their Attorney... .

BTW - Just Curious - (and I'm not Morman) but knowing how things can work in Utah - a few questions:

1. Are You Morman - in Good Standing?

2. Is the Dealership Morman? If so - case fixed - go to the local Bishop and get it solved!

I sued a guy over unpaid lumber taken off my land. HE brought a ATTORNET. I didn't. First I ran a ad in a local newspaper with a ATTORNEYS advise that if anyone having had unfair business practices from so and so lumber company please respond to p. o. box so and so. Ran it 3 weeks. Went to court. I got NOT one reply but thats ok. At court HIS attorney told me that ad sent HIM threw the roof! said he advised his client to settle and let it be. His client said NO. The JUDGE awared us OUR money and and a I'M sorry!(We wanted THAT also)The old duffer would NOT say that in front of his attorney or judge but did to us behind closed doors. We got our check for $1500 dollars and ran a retraction in the local paper(that was asomething HE wanted. Cost to me was a few hours, about $50 bucks to file and $14. 00 dollars each ad. $75. 00 dollars consultaion from a attorney I asked advise from.

I would hurt the dealer where it hurts the most, walk away from the deal and find another truck from a different dealership. The dealer shouldn't have upped the price $100 since you had already signed the Sold Order Protection, and they definitely shouldn't have treated you the way they did after you offered to pay the $100, but since they did, I think it speaks volumes about the dealership. Stay away and tell your friends. Oh yea, and let DC know about it also. I think going to court over something as trivial as this would be ridiculous. The courts are already tied up with a bunch of other meaningless lawsuits, no since adding to it.

with at attitude like that I hope they have line the cars up and down the steet as the transports deliver them because their lot can't hold them anymore due to NO SALESOo. They don't deserve the sale. Hopefully DC Dealer finance will have to repo everything floorplanning on their lot.

while we are at it I think everyone should print out this thread and fax it to DC at . customer care at 248-512-8084. ;)

So has anything become of this? Did the dealer sell the truck, or did DC come to the rescue?

It's so sad that they have little backbone to honor their original agreement, but I wasn't there, so I can't say much.

Please let us know if anything develops. Brent Brown has a SWB 600 Laramie in white that might fill your needs.

if it is really an issue, you can contact your local department of motor vehicles and have them investigate it. I had an issue at a dodge dealer here in La Mesa California back when I bought my 95 brand new. They advertised a loss leader. Then when I wanted that one, they tried to do a bait and switch. I wrote a letter of complaint to the State DMV in Sacramento. The mistake that I made was sending it there instead of the local office because by the time that the local office go it and investigated, I had already bought another truck from another dealer. The investigator told me that the dealer was willing to sell me the truck at the original price because I had reported them. At the time, it was about a 6,000 dollar difference.
